Terms of Service

These Terms of Service ("Terms") govern access to and use of richerthanyou.lol (the "Service"), including the public board, category boards, profile pages, the Hall, achievements, tiers, duels, backing, checkout, and related features. By using the Service, creating or claiming a listing, or completing a payment, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service and do not pay. Before checkout you must confirm, by ticking a box, that you have read and agree to these Terms and that you request immediate performance as described under "No refunds".

These Terms work together with the public Rules. If the Rules and these Terms conflict, these Terms control.

Operator and contact

The Service is operated by The Dutch Merchant B.V., a private limited company registered in the Netherlands, Chamber of Commerce (KvK) number 95880844, registered office Passeerdersstraat 1 H, 1016 XB Amsterdam ("we", "us", "our").

What the Service is

richerthanyou.lol is a paid public status board. You may pay to appear on the board, and your position is determined by the verified total amount paid for a listing. Positions, tiers, achievements, badges, frames, titles, the Hall, duels, backing and every other feature of the Service are cosmetic status items. They record what was paid and what happened on the board. Nothing more.

Nothing is ever paid out. The Service offers no prizes, winnings, cashback, dividends, interest, tokens, or any other return of money or monetary value. Payments are not stakes, wagers, deposits or investments. Status items have no monetary value, cannot be sold, transferred, exchanged or redeemed, and may be changed or discontinued. Money goes in; status comes out; that is the entire product.

A payment buys the position that the paid amount supports at the moment it is confirmed. It does not buy traffic, clicks, followers, customers, endorsement, a fixed duration at any position, or any particular result. Someone else can pay more and outrank you.

Appearance on the board is not our opinion of anyone. Listings are paid placements, not editorial rankings, reviews or certifications. We do not verify that a listed person is in fact richer than anyone.

Eligibility

• You must be at least 18 years old and able to form a binding contract.
• If you use the Service on behalf of a company, you represent that you have authority to bind it, and "you" includes that company.
• You may not use the Service if you are prohibited from receiving services under the laws of the Netherlands, the European Union, or another applicable jurisdiction, including under trade sanctions.

Listings of other people

The Service allows the creation of listings that refer to a real person or their public social profile, including listings created by someone other than that person ("unclaimed listings").

• To identify a listed profile we display limited publicly available information: the public handle, and the public avatar image associated with that handle. We do not display private information.
• Listing minors is prohibited. You may not create, claim, fund or maintain a listing referring to a person under 18. We remove such listings on discovery, without refund.
• You may not create a listing to harass, defame, impersonate, extort or expose any person, and you may not fund a listing where doing so is reasonably likely to cause the listed person harm.
• If you are listed and do not want to be: email legal@richerthanyou.lol from an address or account that reasonably demonstrates you are the listed person, or use the contact route on the listing page. We will remove or anonymise the listing within a reasonable time, and generally within 7 days. Removal of a listing does not refund payments made toward it. You also have the rights described in our Privacy Policy, including the right to object to processing.
• Claiming a listing requires completing the verification steps shown in the claim flow. We may refuse or revoke a claim where verification fails or was obtained dishonestly.

Payments, merchant of record, and taxes

Card and standard checkout is processed by Dodo Payments, acting as merchant of record. For those payments, Dodo Payments is the seller of the digital service you buy at checkout, issues the invoice or receipt, and collects and remits applicable VAT and sales taxes. Dodo Payments' terms and privacy notice apply to the payment itself. Cryptocurrency checkout, where offered, is processed by our crypto payment provider under its own terms.

Amounts are priced in US dollars unless shown otherwise. Applicable taxes may be shown and added at checkout. Position pricing, minimums and increments are described in the Rules and shown before you pay. Completing checkout is an offer to buy status placement on those terms. Position is assigned when payment is confirmed and written to the board.

We never collect or store full payment card numbers.

No refunds

All payments are final and non-refundable. Status placement is a digital service performed immediately: on confirmation, the payment is counted, the board updates, and any resulting position, tier, achievement or record is written. Being outranked later, losing a duel, a change in tiers or features, disliking your category, downtime, or a later removal for breach of these Terms does not create a refund.

By ticking the checkout box you expressly request that performance begins immediately and you acknowledge that, once performance has begun, you lose your statutory right of withdrawal for digital services to the extent the law allows. Where a mandatory consumer right cannot be waived, we honour it.

Chargebacks, payment disputes or reversed payments without a legally required basis are a breach of these Terms. We may remove the associated listing, void associated status items, and refuse future use of the Service. Where a payment is refunded or reversed, any position, status item or commission derived from it may be reversed as well.

Your warranties

By creating, claiming or funding a listing, or submitting any handle or URL, you represent and warrant that:

• You are entitled to submit that listing under the section "Listings of other people".
• Your use of the Service complies with applicable law.
• You are not impersonating any person, brand or company.
• Any information you submit is accurate, and you will keep it accurate.
• Funds used are yours to spend and are not derived from unlawful activity.

Prohibited use

You may not:

• List, claim or fund a listing in breach of "Listings of other people".
• Use the Service for money laundering, sanctions evasion, or the transfer of value between parties.
• Interfere with the Service: scraping beyond ordinary browsing, manipulating counts, bypassing rate limits, automated claiming or payment without our written permission, probing or attacking our infrastructure, or reverse engineering except as allowed by mandatory law.
• Use the Service to publish or link content that is illegal, fraudulent, defamatory, harassing, hateful, violent, sexual, or that exploits children.
• Misrepresent affiliation with us, or present a listing as our endorsement.

Our right to remove

We may refuse, hide, recategorise, anonymise or permanently remove any listing, position, status item, chronicle entry or related page, with or without notice, including where we believe these Terms, the Rules or the law may have been broken, where the listed person objects, where a rights holder or platform complains, or where we consider the material a legal, security or reputational risk. Removal does not create a refund.

Third-party names and images

To operate the board we display public handles and public avatar images solely to identify the listed profile. That display is not sponsorship or endorsement by the listed person or by any platform, and we use only what is needed for identification. X and other platform names remain their owners' property. richerthanyou.lol, our wordmark, our artwork (including badges, frames, tier art and the raccoon) and the look of the Service are ours; you may not copy them or use them to suggest we endorse you.

Licence you grant us

For anything you submit (a handle, a link, a claim), you grant us a worldwide, non-exclusive, royalty-free licence to host, cache, reproduce, adapt for display, and publicly display it for as long as needed to operate, promote and keep an archive of the Service, including the permanent historical record in the Hall. Requests for removal go to legal@richerthanyou.lol; removal does not undo a completed payment, and sealed historical records may be anonymised rather than deleted.

Complaints and rights notices

If you believe a listing or page infringes your rights or is unlawful, email legal@richerthanyou.lol with: (1) your name and contact details; (2) the page concerned; (3) a description of the problem; (4) a statement that your notice is accurate and that you are the rights holder, the listed person, or authorised to act for them. We may restrict the material while we review. Abusive or repeated unfounded notices may be ignored.

Referral programme

Where a referral programme is offered, it is governed by the programme terms shown at signup, which form part of these Terms for participants. Commission never affects any board position or total.

Availability and changes

The Service is provided as-is. It may be unavailable, slow or incorrect. We may change rules, pricing, tiers, features or these Terms. If a change is material, we will update the date at the top of this page; continued use after a change means acceptance. For a completed payment, the Terms in effect at checkout continue to apply to that payment, except where a change is required by law or to address a legal or security risk.

Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that positions, totals, counts, images or chronicle entries are accurate or complete.

Limitation of liability

We do not limit liability that applicable law does not allow us to limit, including liability for intent or gross negligence, or for death or personal injury caused by our fault. Subject to that:

• We are not liable for lost profits, lost data, lost goodwill, reputational loss, substitute services, or other indirect or consequential damages.
• Our total liability for claims relating to a payment is limited to the amount paid to us for the listing concerned in the three months before the claim arose.

Indemnity

You will defend, indemnify and hold harmless The Dutch Merchant B.V., its director and people working on the Service from claims, damages, losses and reasonable legal costs arising out of a listing you created, claimed or funded, your breach of these Terms, your chargeback without legal basis, or your infringement of another person's rights.

Governing law and forum

These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules. If you are a consumer, mandatory protections of your country of residence remain unaffected, and you may sue or be sued in the courts your local law provides. Otherwise, the competent court in Amsterdam has exclusive jurisdiction.

General

• If part of these Terms is unenforceable, the rest remains in effect, and the invalid part is replaced by the enforceable term closest to its intent.
• Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
• These Terms, the Rules, the Privacy Policy, any referral programme terms you accept, and the checkout details you confirm form the entire agreement.
• Payments, hosting and analytics involve third parties, including Dodo Payments. Their outages or decisions are outside our control.
